Terms and Conditions

This page details the terms and conditions that Island Adventures Limited operate. Island Adventures may be described as ‘IA’ or ‘the company’ in the document.

In these terms and conditions: a) the expression “the owner” shall mean the person or persons who own the land upon which the activity session takes place. b) The expression “the customer” shall mean the person who signed the booking form. c) The expression “property” shall mean any land, accommodation or contents thereof or any item owned by the owner. d) The expression “the company” shall mean Island Adventures.

Bookings

Submission of a signed booking form, or telephone booking with deposit paid by cheque, cash or direct bank transfer, will be deemed to be an acceptance of all terms and conditions detailed in this document, and a confirmation of the details and conditions on the booking form. The person who signs the booking form warrants that he/she is authorized to agree to IA’s terms and conditions and is acting on behalf of all persons including those substituted or who join the party at a later date. The person who signs the booking form is responsible for ensuring that all persons in the package comply with the terms and conditions and in all respects.

Travel arrangements/bookings are at the participant’s discretion. IA accept no liability for cancelled travel bookings and costs.

Participants have a responsibility to inform IA of any medical issues that may impact on the safety of themselves or the group. They must inform IA of any medical issue that may arise between the booking phase and the session commencing.

All activities are fully risk assessed and insured, a copy of both are available on request. Participants should be aware that outdoor activities are ‘assumed risk sports’ that carry attendant risks. They must be aware of this, accept these risks and be responsible for their own actions and involvement.

All specialist equipment required for the activity will be provided by IA. Personal protective equipment supplied must be worn when requested by the instructor.

Whilst IA uses its best endeavors to ensure accuracy of all information supplied and details of sessions are given in good faith, no warranty is given as to their accuracy and it does not accept responsibility or liability for any loss or damage resulting from information given or statements made whether orally or in writing.

Payment

Full payment is required BEFORE any activity can commence, and no activity session will be confirmed until payment is received. If the booking form is submitted before the commencement of the activity then the full payment should be sent with the booking form. If the booking form is completed at the start of the activity, full payment must be received or IA reserves the right to refuse participation. If the customer cannot or does not attend a session, or cancels with less than 48 hours notice, they may forfeit the balance paid or may be liable for the balance to be paid. This is at the discretion of IA management.

Gift vouchers

Gift Vouchers are valid for 12 months from issue date and must be produced at the booking phase.

Change is not normally given if session booked is of a lesser value than the value of the gift voucher presented. However, IA may, at their own discretion, give change in the form of further gift vouchers.

Gift vouchers cannot be exchanged for cash.

Gift vouchers will be subject to verification at time of presentation and IA reserves the right not to accept any vouchers that have or appear to have been forged, damaged, defaced or otherwise tampered with.

No responsibility will be accepted for lost, stolen, or damaged gift vouchers and such vouchers shall not be refunded. To deface a voucher will render it invalid.

Allow 5 working days for delivery of vouchers by First Class post.

Loyalty Cards

Loyalty Cards are valid for 12 months from issue date and must be produced at booking phase.

Loyalty cards cannot be exchanged for cash and hold no monetary value.

Loyalty cards will be subject to verification at time of presentation and IA reserves the right not to accept any cards that have or appear to have been forged, damaged, defaced or otherwise tampered with.

No responsibility will be accepted for lost, stolen, or damaged loyalty cards and such cards shall not be refunded. To deface a card will render it invalid.

Admittance to activities

IA reserves the right to refuse admittance to activities and/or accommodation either on its own account or on behalf of the owners. In such cases all liability of IA and owners shall cease.

Group bookings

All group bookings are liable to the same terms and conditions as individual bookings. The group leader shall be considered responsible for booking arrangements and associated payments.

Course pre-requisites and BCU registration

In any event where pre-requisites are required, such as BCU courses, it is the responsibility of the customer to ensure that these are in place before course commencement.

It is the responsibility of the customer to ensure that they are registered with the BCU in advance of any personal skills course. Please refer to the BCU website: www.bcu.org.uk

In the event that a customer turns up to a course without the required pre-requisites or BCU registration their course fee may be forfeited.

Certificate fees

Students on courses are responsible for the payment of any BCU/UKCC Course fees on successful completion of a certified course. This is payable at the end of the course.

In any circumstances where the fee is not paid, and no arrangements are made to pay the fee the students name will not be entered onto the Course schedule and the BCU will not be notified of Course attendance resulting in no certificate will being issued.

Under 18’s

Any participant under the age of 18 years must have the explicit permission of his/her parent or guardian before being able to take part in any activity/course offered by IA. The parent or guardian needs to be aware and accept the risks involved in adventure activities and satisfy themselves accordingly.

Cancellations

Participants should be aware that all activities are weather dependent and are liable to cancellation due to severe weather or dangerous sea conditions.

Any booking is made on the understanding that the session is available to the customer on the dates stated. If for any reason beyond IA’s control (e.g. fire, storm damage, illness, sale or withdrawal of the land by the owner for any reason etc) the session is not available on the date booked IA will use its best endeavors to provide an alternative course to the customer but cannot guarantee that such will be provided. If such cannot be found or is not suitable for the customer then all monies paid by the customer shall be returned in full. IA shall not be liable for any consequential loss, expense, inconvenience or otherwise resulting from such unavailability or unsuitability and the customer shall have no claim against them. The customer shall advise IA within seven days of being offered an alternative course whether or not it is acceptable. If the alternative course is more expensive IA reserves the right to charge the difference in cost.

Loss/Damage

The customer shall fully indemnify IA against any loss to the company arising from any claim made by the owner as a result of any action of the customer whether by way of damage caused to property, failure to pay the owner or in any other way whatsoever.

IA can give no guarantee or warranty as to the state or condition of properties of the owners. IA will not be liable for any act, neglect or default on the part of the owners or any other person, or breakdown of any properties, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property which the customer or any other person may suffer or incur.

The customer shall be liable to the owner for any loss, costs, expenses or claims arising from any damage caused to properties by deliberate or negligent act or omission of the customer or of any person in his/her party. If, as a result of such damage, properties need to be repaired or any of the contents need to be replaced then the customer shall be responsible for paying the reasonable costs of doing so.

Customer Satisfaction

If for any reason the customer is not satisfied with the session, the company must be contacted within 5 working days so that the problem can be rectified immediately. Under no circumstances will IA’s liability exceed the price paid for the package.
